  全民普法是一项中国特色的法律普及活动。从1986年开始,我们连续实施了5个五年普法规划,广泛普及宪法和法律知识,深入推进各项事业依法治理,取得了明显成效。但是,在我们这样一个缺乏法治传统的国家建设成为社会主义法治国家,真正做到全社会都崇尚法律、遵守法律、维护法律,依然任重道远。从这个角度讲,全民普法没有终点,要坚持打持久战,持之以恒、长抓不懈。

  随着中国特色社会主义法律体系的形成,中国法治建设的重心正在由立法转向执法、司法和普法,普及法律知识、弘扬法治精神、培育法治文化,将成为新时期法治建设的重大任务。法制宣传是指在全体公民中开展以普及法律知识为内容的宣传教育活动,目的在于提高公民法律意识,树立法律信仰,尊重法律权威,提升全民法律素质,通常简称为“普法”。法制宣传是依法治国的一项基础性工程,也是社会建设的一项基础性工作。从社会建设的角度讲,法制宣传是一项政府主导、全社会共同参与,旨在提高公民法律素质的公益性社会事业,需要全社会共同参与,引导社会力量共同参与。

  全民普法,要不仅仅满足于普及法律知识,更要注重弘扬法治精神和培育法治文化,努力形成自觉学法尊法守法用法的社会氛围。中央政治局3月28日进行了第二十七次集体学习,“弘扬社会主义法治精神”成为学习的重要主题。随着中国特色社会主义法律体系的形成,我国法治建设也进入了一个新阶段,比形成中国特色社会主义法律体系更为艰巨的是社会主义法治精神的培育。新时期的法制宣传教育要更加致力于培养公民崇尚法治、追求公平正义的价值观,把尊崇和信仰法治的精神融入全体公民的血脉之中,融入党和政府的政策文件,融入国家的政治生活、经济生活和社会生活,也融入老百姓的日常生活。以尊重权利和遵守法律为荣,以滥用权力和违反法律为耻。对于行使公权力的国家机关而言,弘扬法治精神,就是要以人为本,以法为尊,尊重和保障人权,对约束公权力的法律要有一种法治政府和责任政府应有的敬畏之心。唯有如此,法治精神才能内化为政府的亲和力和凝聚力,政府才能真正赢得民心和树立威信。当然,法治精神的培育不可能一蹴而就,而是一个需要全民总动员的漫长的实践过程。

  “五五”普法已接近尾声,“六五”普法即将开始。在新形式下,能否能继续深化普法依法治理工作,进一步提高全民法律意识和法律素质,提高全社会法治化进程,实现依法治国方略。很大程度上取决于是否有一部适应社会形势需要的普法规划,下面,就“六五”普法的保障措施谈谈看法。

  一是要强化组织领导保障机制。法制宣传教育是一项全民工作,涉及面广。因此建立一个具有指挥全局的权威的领导机制,是实现普法目标向更高层次迈进的关键所在。前些年,通过各级普法机构的努力,基本保证了普法工作的深入,工作机构不协调、不适应的问题较为突出。“六五”普法依法治理工作要取得突破性进展,必须形成更加科学的、统一的、强有力的组织领导机制。各级普法依法治理领导小组办公室可与本级司法行政部门合署办公,但应作为常设机构设置,配备一名同级副职为专职副主任和3名以上专职工作人员,并单独列编。

  二是要强化刚性保障机制。我国已将“依法治国、建设社会主义法制国家”这一基本治国方略载入宪法,有些地方也尝试立法。但仅限于对法制宣传教育工作进行规范,依法治理工作则很少涉及,致使法制建设工作长期处于无法可依,甚至出现用传统行政手段抓法制建设的现象。因此,国家应尽快为普法依法治理工作立法,以法律法规的形式确定其组织、机构、职能、责任、义务等,应确定普法依法治理工作的权威地位。“六五”普法期间,还要进一步健全完普法依法治理工作责任制度,考试考核制度,监督制度,评比奖励制度,并用法律法规加以确定,以规范和约束依法治理工作。

  五是要加强队伍建设保障机制。普法队伍建设是普法依法治理工作能否顺利进行的根本保障。但是,就目前队伍建设壮况来看,仍是一个薄弱环节。拿我县来说专职普法人员2人(编制在司法局),基层单位多数是兼职人员,这根本不能满足日常普法工作需要。“六五”普法期间,一方面可以通过单独列编的形式,彻底解决普法人员不足,不专的问题。另一方面要加强法制新闻队伍,法制文艺宣传队伍,法制宣传队伍“五支队伍”建设力度,充分发挥他们在法制宣传教育中的中坚作用。同时加强执法建设,提升队伍的整体素质,坚决清除那些违法建纪人员,促进执法状况的全面改善,以引导广大人民群众更好地学法,守法和依法办事。
